Terms of Service
Last updated: 05 October 2026
These Terms of Service ("Terms") govern your use of AccessWay (the "Service"), provided by AccessWay ("AccessWay", "we", "us"). By creating an account or installing the Service on a website you agree to these Terms.
1. The Service
AccessWay provides an accessibility toolbar that website owners can add to their websites, together with a dashboard, usage statistics, an automated page scanner and an accessibility statement page. The toolbar lets visitors change how pages are displayed in their own browser (for example contrast, text size, spacing and fonts).
2. No guarantee of compliance
The toolbar is a supplementary tool. Using the Service does not by itself make a website conform to the Web Content Accessibility Guidelines (WCAG), the Americans with Disabilities Act (ADA), the European Accessibility Act or any other standard or law, and it does not protect you from complaints or legal claims. The automated scanner detects only some common issues and cannot determine conformance. You remain responsible for the accessibility of your website, including accessible design, development and testing. Nothing in the Service is legal advice.
3. Your account
You must provide accurate information, keep your password confidential and be at least 18 years old or the age of majority in your country. You are responsible for all activity under your account and for the websites on which you install the Service. You may only install the Service on websites you own or are authorised to manage.
4. Plans, trial and traffic limits
Plans include a monthly limit of pageviews (page loads on which the toolbar is displayed) and a number of websites. New accounts may receive a free trial; at the end of the trial an invoice is issued for the selected plan. If your monthly pageviews exceed your plan's limit, your account is moved to the smallest plan that covers your traffic and an invoice for that plan is issued, with a credit for unused days of your current paid period. If an invoice is not paid by its due date, the toolbar remains visible on your websites but its tools are disabled until payment is received.
5. Payments
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Prices are shown excluding applicable taxes, which Paddle calculates at checkout.
6. Acceptable use
You must not use the Service to break the law, to infringe the rights of others, to interfere with or overload the Service, to attempt to access other customers' data, or to scan websites you are not authorised to test.
7. Availability and changes
We aim to keep the Service available but do not guarantee uninterrupted operation. We may change or discontinue features; we will give reasonable notice of material changes to paid plans.
8. Termination
You may delete your account at any time from your profile. We may suspend or close accounts that breach these Terms. On deletion, your websites, statistics and reports are deleted.
9. Limitation of liability
To the extent permitted by law, the Service is provided "as is", and AccessWay is not liable for indirect or consequential damages, or for claims arising from the accessibility of your website. Our total liability is limited to the amounts you paid for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.
